Handling The Logistics of Labor law

Capielo Law would be proud to serve as your employment lawyer. We possess a keen eye for uncovering the best resolution for clients.

Wrongful Termination/ Discrimination
Have you been recently let go from a job and feel there is more going on than just “downsizing?” California is an “at-will” employment state. This means the employer and the employee can terminate the employment relationship without reason. This does not mean an employer can terminate an employee for any reason. Employers cannot terminate employees based on their race, national origin, age, gender, marital status, disability or sexual orientation, nor can they terminate employees in retaliation for making complaints about unfair treatment or harassment to name a few.

If you feel you were wrongfully terminated from your job then call an employment lawyer who can prove you are entitled to compensation.

Sexual Harassment
Do you feel you are or were being sexually harassed at your work? This is a very sensitive issue that often leaves the harassed employee in a difficult situation. You don’t want to continue working under such circumstances yet fear any whistle blowing on the situation will cost you your job and great embarrassment. The right employment lawyer can help you to understand your rights and determine an appropriate course of action.

Wage Claims and Overtime
California law provides specific rules about how to calculate overtime, meal periods and vacation pay. An employer must pay an employee all that is owed on the employee’s last day of work. If you feel your employer did not pay you all that you are entitled on your final day of employment then contact an employment lawyer to discuss a possible wage claim.

Information Technology workers are you overworked, earning a salary and classified as exempt from overtime?  You may be entitled to overtime under California and Federal labor laws.  Give us a call for free consultation.

Retaliation/ Whistle blowing
Sometimes just complaining about unfair treatment is not enough. Time to call an employment lawyer if you were terminated and can answer yes to any of the following questions:

  • Have you complained to your employer about any violations of labor laws such as failure to pay overtime, lack of meal breaks, sexual harassment?
  • Have you complained to a state agency about labor law violations?
  • Have you testified on behalf of a co-worker who had complaints against your employer?
  • Were your fired or demoted as a result of “doing the right thing?”

Independent Contractor v. Employee
Capielo Law has an employment lawyer that can help clear the picture when the lines get blurry. There is a very important distinction to be made between independent contractor and employees. Work titles and even contracts can be deceiving wherein contractors may really be employees or vice versa. Employees are entitled to overtime and meal periods which can add up over time if an employer fails to follow the state’s strict labor code and guidelines.

Employment Contracts
If you are an independent contractor or an employee and have a written contract and have not been paid or the contract was terminated prior to the termination date then we want to help. Call or email an employment lawyer at Capielo Law now for a free consultation.

Contractor agreements
If you intend to utilize independent contractors in your business make sure you are not misclassifying an employee as a contractor. Doing so can potentially mean liability for unpaid overtime, meal periods or even EDD fines and penalties. All independent contractors and their employers/clients should have written agreements outlining the duties and obligations of the employment relationship. We can create contractor agreements to suit your needs and protect your business.

Small Businesses/ Employers
Concerned about whether your company is in compliance with CA and Federal Labor laws? Call upon the skills of an employment lawyer for a through review. We can plan a course of action to meet any deficiency should they be discovered.
